1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. The Service
AI Installer is a flooring and tile installation estimating platform. It generates cost and material estimates based on the information you provide through chat, guided interview, or manual entry.
3. Estimates and Final Pricing
Estimates produced by the Service are calculated from the information you provide — including measurements, product and material selections, and project details. An estimate is only as accurate as the information entered, and it does not constitute a binding quote, contract, offer, or guarantee of final price. Because actual materials, labor, and on-site conditions can differ from the information provided, final pricing may vary and should be confirmed before any purchase or installation. You are responsible for the accuracy and completeness of the information you enter and for verifying quantities and pricing before relying on an estimate or making a purchasing or contracting decision.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Subscriptions, Billing, and Trials
- Paid features are offered on a subscription basis at the plans and prices described at checkout. Subscriptions renew automatically for the applicable period unless cancelled before the renewal date.
- Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the applicable fees.
- Any free trial converts to a paid subscription at the end of the trial period unless cancelled beforehand.
- You may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or infringing purpose.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, scrape, or resell the Service except as expressly permitted.
7. Third-Party Services
The Service relies on third-party providers, including Stripe (payments) and Anthropic and OpenAI (AI processing). Your use of features that depend on these providers may also be subject to their terms. We are not responsible for the acts or omissions of third-party providers.
8. Intellectual Property
The Service, including its software, design, and content, is owned by Estimates Now LLC and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the content and information you submit.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that an estimate will match final project costs.
10. Limitation of Liability
To the maximum extent permitted by law, Estimates Now LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Estimates Now LLC from any claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately.
13. Governing Law
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in that state.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
